At the meeting October 14, 2010 the Luna County Commission adopted Ordinance 77. This is the last Ordinance addressing the issues contained in Ordinance 37. The Commission has adopted Ord. 74 concerning Nuisance Abatement; Ord. 75 addresses Building Code; Ord. 76 addresses land splits and recombination and Ord. 77 addresses Manufactured Home Transportation and Installation and Recreational Vehicle Standard. Within Ord. 77 is a statement "adoption of this Ordinance hereby repeals Luna County Crdinance No. 37, Second Revision." This goes into effect 30 days from the day of adoption, so Nov. 14, 2010 Ord. 37 ceaces to exist.
In my opinion the most important factor involved is the end of minimum lot size. The only thing a buyer has to be concerned about concerning lot size is abiding by regulations set forth by NM Environment Department concerning septic systems and wells on the same property. If you are an owner of Deming Ranchettes or Sunshine Valley Ranchettes you should be able to develope a 2 lot parcel. It will take 2 lots to satisfy the EID requirement of 3/4 acre for a well and septic system.
