Many homeowners are going through a difficult time but the unseen face of this credit crisis is the tenants. Over 20,000 renters have been affected by the foreclosures in California. To our credit California is a very tenant protection state. These laws work well when applied to the normal landlord-tenant situation however, we are seeing some faults in the system when it comes to "successor in interest". These new owners acquire these properties through residential foreclosures.
Our California legislature has a series of bills before them currently which we hope will help.
Assembly Bill 2586 (Torrico) has passed the Assembly and is now in the Senate. The bill is designed to stop the harassment of tenants in foreclosed properties from new owners trying to get a tenant out of the property before the 30 days eviction notice. We have read of new owners turning off utilities,telephone, elevator, or refrigeration in order to "push" the tenant out. This bill is addressing many of the tenants issues.
Assembly Bill 2586 will not solve all of the current problems. A tenant may find that his lease is no longer valid or will have to renegotiate the terms. Many past homeowners who now are tenants may find they must move again and disrupt their family one more time.
