What stays, goes with a house sale can be confusing

This is a good article about what stays with the property and what does not when it is sold.

Item 9 of the Contract for the Sale and Purchase of Real Property copyright San Francisco Association of Realtors (the contract used for making an offer on property in San Francisco, CA) states:

"Fixtures: All fixtures and fittings attached to the Property and major appliances for which custom openings or encasements have been made are included, free of liens, in the Purchase Price, including electrical, lighting, plumbing and heating fixtures, hardware, solar systems, screens, awnings, shutters, window coverings, drapes, curtains, and related hardware, attached floor coverings, television antennas/satellite dishes and related equipment, water softening systems, air coolers or conditioners, pool and spa equipment, mailbox, garage door openers and transmitters, security systems, private telephone systems, trees, shrubs and outdoor plants planted in the ground, and items permanently attached to the Property, except for:_________________"

But in practice, it is best to actually write in anything you want that you are unsure of in item 10, Personal Property.

Item 10 states: (For Residential Property) Note to Buyer: Personal Property items listed in the marketing materials are not included in the sale unless specified here. The following personal property on the Property at the date of Acceptance is included in the sale, free of liens and without warranty of condition:______________________"

Even though items such as curtains, built in microwaves, etc. are included under item 9, it is best to list them in item 10 to avoid any confusion or problems down the road.

So if you love that original light fixture in the living room or those silk curtains in the bedroom, make sure you list them in item 10, even though they are included under item 9 and save yourself the disappointment and hassle later when you walk into your new home for the first time!

The developer of this project has a great track record with loft conversions in San Francisco and LA. They are known to have some of the most true (i.e. New York-style) lofts on the market. It is reported as being almost half sold out already, which does not surprise me.

The beautifully renovated Hales Warehouse, located at 410 Jessie Street offers 52 residential and live/work units available for sale. The historic building features light-filled spaces with magnificent city views. The street level will soon be home to a captivating French Bistro.

The original structure was designed by the Reid Brothers architects, renowned for such buildings as the Fairmont Hotel and the Hotel Del Coronado in San Diego.

From SocketSite: In 2002 Lakeview Ventures received approval to build an “affordable housing project” of 141 apartments at 724 Van Ness (actually two towers, a 14-story tower on Van Ness and a 7-story tower on Turk). Two years later, the project was sold to condo developer West Bay Builders. And today, construction of Symphony Towers is well underway, but in the form of 130 condominiums (~16 BMR) which should be finished late 2006/early 2007.

It’s a classic case of urban infill, and how despite the fact that “they’re not making any more land,” two one-story buildings (housing an auto shop, restaurant, and retail) can become 130 new homes (albeit not overnight).

From the people who brought us The Four Seasons comes the Millennium Tower. The aptly named Millennium Partners have experience and success in high-end condominium building, so it will be great to watch the progress at 301 Mission Street.

The following is from Wikipedia, the free encyclopedia: The Millennium Tower or 301 Mission Street is a blue, all glass, 60-story highrise condo tower currently under construction on the border of the South of Market and Financial District in San Francisco. This $400 million project was developed by Millennium Partners, of New York City and designed by Handel Architects.

Rising 645 ft. into the air, it will be the fourth-tallest building in San Francisco and tallest building to be constructed (currently) since 345 California Street in 1986. The Millennium Tower complex in which the tower rises from (on the south end) is located on Mission Street and bounded by the Fremont and Beale Streets and the north end of the Transbay Terminal. In addition to the 60-story tower, there is a shorter, 125 foot (38 m) 11-story tower on the north end of the complex with more condos and residential amenities. In between the two towers, there will be a two-story glass atrium at about 43 ft. (13 m) tall.

In total, the project will have 437 units, some of which (~120) will be extended-stay hotel units and the others residential units. The will be 350 parking spaces in a 4 story underground garage, with a parking space to unit ratio of about 0.8. The tower is designed to resemble a translucent crystal and to be a landmark for the Transbay Redevelopment and the southern skyline of San Francisco.

A noontime forum, held at SPUR, 312 Sutter St. (at Grant), Fifth Floor, from 12:30 to 1:30 pm.

 As the intermodal hub for four transit agencies, Greyhound, a bicycle station, underground pedestrian access to BART, and the downtown terminal of Caltrain and high-speed rail, the new Transbay Transit Center will transform regional transit. It will also transform the neighborhood, with 3,400 new homes and 1.2 million square feet of office space planned to help pay for, and take advantage of, the new center. One Rincon Hill was approved by the San Francisco Planning Commission on August 4, 2005. It will be constructed in two phases with parking for 455 cars. The entire complex  is classified as a high-rise life safety project. The Clock Tower Building was demolished in 2005 to make way for this complex. A ceremonial groundbreaking took place in November 2005, but permits for construction were held up by the San Francisco Department of Building Construction until January 2006. At issue was the new use of the core-outrigger structural system, a first for earthquake-prone San Francisco. City officials agreed with structural engineers on the use of this system after additional review.

On the sunny northern slopes of Potrero Hill is the appropriately named "The Potrero", a new mid-rise development. With great weather and lots of sun in a neighborhood that is considered both a favorite and a classic, The Potrero is sure to be a hit with buyers. The Potrero is close to the new UCSF/Mission Bay Development and the freeways for both East Bay and South Bay access while being in a very relaxed urban environment.

I think that there is a lot of upside to this development in that Potrero Hill is a favorite location for both locals and buyers that move to San Francisco, it has some of the best weather and is right next to the UCSF/Mission Bay development as mentioned above. I expect that this development will be a great buy for both buyers that intend to live there and for those that want to buy it as an investment. With all the high-paying jobs coming to the UCSF/Mission Bay campus and the lack of development opportunities in the immediate area, I think this will have higher than average price appreciation.

Housing near the zoo shooting for LEED gold.

Article states that a developer is trying to get a 55-unit development on Sloat Avenue LEED gold certification. This is right across from the San Francisco Zoo, which is also down the street from the best dog walking area in San Francisco, Fort Funston

It is reported that "it uses stones that tie in with the beachfront environment and will have an open waterfront plaza in front that may house a farmers' market".

AGI Capital, founded by Alexis Wong, is one of the lead developers of the SOMA Grand. This is a great interview about the building, the area and San Francisco in general.
 
Since she founded AGI Capital in 1998, the company has completed over $500 million of development and investment opportunities and Alexis Wong has led the company to growth as a multi-million-dollar, vertically integrated real estate investment and development firm.  In October 2006, Ms. Wong led the effort to successfully form a joint venture partnership with TMG Partners and CalPERS (California Public Employees Retirement System), a $230 billion and second largest pension fund in the U.S. to invest $100 million in urban infill housing projects.  This joint venture is first of its kind with CalPERS and AGI Capital is the first Asian developer receiving such allocation.

Under Ms. Wong’s leadership, AGI Capital received the distinguished awards such as one of the Largest Residential Developers in the Bay Area and Top 100 Women Owned Businesses in the Bay Area.  Ms. Wong also recently just received the recognition by the San Francisco Business Times as one of the Most Influential Women in Business.

With 15 years of experience in real estate management, development, and investment property brokerage, Ms. Wong has managed, developed, and overseen most types of real estate projects including retail, office, large multi-family investment projects, land development, adaptive re-use, and condominium conversion projects. Through her insights and progressive investment philosophy, Ms. Wong has led many projects which preceded and drove upward trends in Bay Area regions.
