Well, the web traffic shows that lots of people are still interested in Sotherby Homes going under. With over 1,000 unique visitors between my two previous posts on Sotherby Homes, I decided it was time to create a place for readers to post questions, comments, updates, information (company contact info. anyone?) and issues as they relate to Sotherby Homes. Check back occasionally to see if anyone has answered your questions or posted any interesting updates. Obviously, they're are lots of people affected by this home builder's implosion. I'd love to see the earnest money returned to Buyers who were expecting Sotherby to build their dream home (I've talked to several buyers who are out thousands of dollars); and I'd love to see vendors who did work for Sotherby get paid (I've been contacted by more than one vendor who was out thousands of dollars). I don't know that either of these will ever happen, but I was interviewed by WFAA's Jonathan Betz about this very topic (Sotherby and Buyers out thousands). So, post away... I'm eager to hear what's going on and if anyone knows anything new. Note that comments have to be approved before they will show up (i.e. nothing vulger please); that generally happens within 24 hours.

I was out several thousand dollars on a Sotherby home in the Tribute, and the week they went out of business they were calling me to deposit another $10K.  I know other buyers who are out over fifty thousand, and contractors out more than that.

It is almost impossible to track down Peter Shaddock Jr but I did file a complaint at the TRCC - http://www.trcc.state.tx.us/forms_library_test/Complaint_Form_misc.pdf

I hope every contractor, customer and homeowner who lost also files complaints so that we can make sure he doesn't do business in Texas again until we've all been repaid.  He has several other businesses registered under his name with the TRCC.

I saw some Sotherby homes (new, never owned) for sale in the Shaddock Park subdivision in Allen, Tx.  One was built in 2007, still new, never lived in?   Who are selling these homes?  Who owns these homes since Sotherby is no-more?  I assume Sotherby homes aren't popular due to their bankruptcy and futile warranties.

There are several Sotherby homes being sold like this. They are mostly bank foreclosures (with a few bought by, and now being sold by, Shaddock Homes).

For the foreclosures, the banks are either going in and paying contractors to finish them out or, sometimes, they are simply sold unfinished. Either way, they are new homes, never owned or lived in... the seller is a bank. These homes almost certainly won't come with any warranty... but they come with a nice price. So, some buyers are willing to take gambles that they're built well enough since they can get them at a better price. A good inspector can help, but they can't see through walls, so it's still a gamble for sure.

Any Sotherby Homes that were bought by Shaddock Homes might be offered with a warranty, but I believe that these are much fewer and further between.

Sotherby Homes has ceased operations.  This unfortunate event is the result of our lenders suddenly and unexpectedly curtailing our available credit due to the national banking crisis.  We sincerely regret the fact that this situation prevented our company from completing some homes and has resulted in inconvenience for our valued customers, realtors and vendors. 

 

The only business of Sotherby Homes was new home construction and it is in no way related to any other company using the Shaddock name or other enterprises owned by members of the extended Shaddock family.  The unrelated Shaddock businesses continue to operate successfully, as they have for many years, in the building, development, title and mortgage-related industries.  The extended Shaddock family members are not and have never been involved with Sotherby Homes.

Warranty Issues

 

Each Sotherby Home that was completed and sold is most likely covered by a warranty. Warranty information is included in the package of information each homeowner received at closing.

Lien Issues on Closed Homes 

It is our intent to make every attempt to resolve lien issues on homes closed by Sotherby Homes.  It is our goal to have this complete on or before October 1, 2009, or within 60 days of receiving notice of any lien issue.  If you have a lien issue, please advise Sotherby Homes in writing.

Sotherby apologizes for issues affecting our trade partners and subcontractors due to our shutdown.  Sotherby is making the resolution of vendor issues on homes closed by Sotherby a top priority and we hope to have all of these issues settled in the near future.
