The lot adjoining the Deer Creek entrance.

 

 

As you probably know, there is no traditional "zoning" in Cumberland County.   Property usage is controlled by deed restrictions, either of the individual parcel or of the subdivision that the parcel lies within.
 

 

The parcel in question (pink 1 acre lot below) is not part of Deer Creek.  The restrictions in the deed of this parcel  read as follows:  "shall be used only for residential purposes (and uses incidental thereto), including multi-family, town homes, condominiums and golf multi-family, condominiums and golf villas and not for commercial purposes.  In no event shall any portion of the property be used for time-share arrangements".

 


Update: Joe Looney, the Deer Creek HOA attorney, has reviewed the deed and confirmed that this property can not be used for commercial purposes.   Thank you BOD for getting this clarification!

 
 
   
 
 

The yellow parcel was going be the location of a patio home project.  I haven't spoken to the builder recently to confirm whether this project is still "in the works" or has been indefinately postponed until the housing market rebounds. 

 

The dark green parcels at the Deer Creek entrance are owned by our HOA. 
 

 

The pink parcel is the 1 acre lot that recently went up for sale.  The deed was granted  to Deer Creek Golf Community, (Gina Brown), by Deer Creek Home Owners Association in 1996 - many years before the transfer of control to our current Home Owner's Association.

A reminder from your Board of Directors

With the upcoming elections (local, state and national), Deer Creek residents are asked to remember Article XII of the “Use Restrictions”.
 
Section 1.  “No sign of any kind shall be erected within the Properties without the written consent of the Board of Directors. ….”
 
This does pertain to signs advertising support of political candidates.
Please be advised, the Board of Directors will not provide written consent for any political signs within Deer Creek.
