In Real Town's endorsement of Docu-Sign, I would like to toss in my opinion. I have been using Docu-Sign since last Fall. It is a FABULOUS tool and I really don't know how I lived without it. However, there are some state's in the country, brokers still in the Dark Ages, and even FHA and VA, who do not recognize electronic signatures. We need to get these states, brokers and government branches to recognize the reality of the cyber world immediately.
 
I do a lot of short sales. States that do not recognize electronic signatures, where these lenders reside, force a 'hard signature' on each document, including the Listing Agreement. The inconvience, after getting used to the ease and immediate management of the documents, is overwhelming. But, most astonishing, is large brokerages in my state (AZ), that refuse to allow their selling agents to 'accept' documents in a transaction that have an electronic signature. It is legal in our state, and recognized by our board's legal departments, but some of these traditional, older brokerages, think that they can dictate to listing agents of other companies as to how THEIR client (the seller) signs the documents. I had one agent with Coldwell Banker BEG me after close of escrow, to have the out of state seller RE-SIGN all of the documents with hard signatures. If I was unable to do this, then her broker was not going to pay her on the transaction. Because this agent was fully entitled to her commission, I convinced the seller to re-sign and sent the paperwork to her broker. I also sent a letter to her broker, that our company uses the 'legal process' of electronic signatures. In future transactions with their company, these are the ONLY documents they will receive. If they want 'hard signed' copies for THEIR files, I would be happy to provide the seller's contact information AFTER close of escrow so that they can gather those signatures themselves.
 
As with all new and good technology, you have dinosaurs that will resist it. Knowing the possible problems and planning for them in advance, will make the transaction less burdensome for you.

Dede, I am with you I do everything I can to go Green Docusign is a super way to write and deliver a contract. I am asking escrow to forward all documents to my attention in pdf file for record storage. I have had lenders, including Bank of America/ aka Countrywide demand a hand signed offer using the excuse that HUD or Fannie Mae requires and in some cases likewise Asset Manager demand a hand signed contract. Seems to be the hold 5 steps forward, 7 back.

I've used Docusign for several years and consider it one of my 'can't live without' tech tools.

I have also, like Deede, had problems with those who basically fear this type of time saving technology and insist that we 'adjust down'.

I blogged at length a couple of years ago about a loan processor who accused me of 'stamping' signatures and insisted I get ink siggies from my clients a month after closing. She and her manager got an earful from me and I have kept my promise never to use that company again.

The GREAT thing about Docusign is that all the copies are originals, as clear and readable as the moment they were signed. Try that with a 5th generation fax!

Hi Candice,
 

I had a similar situation with a lawyer - way back in 1990, when the use of fax machines was only a couple of years into the real estate market. A new woman lawyer in town who had moved here from a whole other part of the country, was acting on behalf of a seller. Buyer was from out of town, and sure enough, we were "using the fax machine." She insisted on having live signatures before consummating the transaction... so we had to courier "real copies" to be signed in addition to the fax sigs.
 
 
She insisted I put the paperwork in a cab, immediately, to her office once I had received it, at the other end of town. Here we are nearly twenty years later and I have NEVER directed a buyer or seller to her office. Her loss. No need to make life difficult. Realtors have long memories.
 
Another local woman lawyer pulled another stunt last year. She told a seller that they had paid higher than "the standard" commission... that they could have paid as little as 1% and likely shouldn't have paid more than 5%. Who does your agent think she is? - or some retort... I was ready to have her head on a platter for interfering with my contract. What's with these power-trips anyhow?

Hi, I have been using Docu-sign for a number of years with no issues save that of not being Mac friendly. It is legal and there is even federal support for it. I would contact Docu-Sign for the background info and tell the backwoods firm to catch up on federal legislation that allows for electronic signatures. I would not bend to them but rather assist them in joining the world already in progress. I chair our office tech comm, board IT comm and sit on our regional MLS comm and am amazed at the entrenchment of the "great" local realty firms. I refuse to give in but keep moving forward instead. They eventually see the light and join and forget that they were the biggest oppenents when they "get" the benefits.
