With more and more focus being put on syndication of listings on more and more websites (Saul is one of the major supports of this movement) now is the time to be studying how this will affect your way of doing business and not just "get sick" about the fact that things are changing. Shifting business models are a part of the world now. The turmoil in the real estate market right now is creating the perfect storm for new business models to be tested and to grow. This step by Move Inc to start taking FSBO listings clearly provides an alternative to the Listing/Selling Agent "traditional" real estate business model. It opens up much greater direct access by home owners to Selling Agents without having to pay a Listing agent. It will be interesting to see what effect this has on the industry as a whole over time.

HERE! HERE! You are absolutely right - the traditional Real Estate Model has to change - we have to Cross The Chasm, adapt or die. Most FSBOs I talk to don't need to be sold on offering a commission to the Realtor bringing a buyer - they're already doing it. But when I ask them how Realtors are supposed to know that or find their property, they get a blank look & have no answer. This is the answer. Home sellers who buy that particular package will be able to promote their property to Selling Agents. The only thing I disagree with is the idea that homeowners will "figure out" that 1% doesn't bring a buyer. They won't. They'll just scratch their heads. Lower the price. Paint the living room. And, eventually, list with a Realtor.

And you should also remember that Realtor.com is NOT a part of NAR. It is
operated by Move Inc...with an operating agreement given to them by NAR to
use the Realtor trademark. It is not YOUR website...it is simply a
commercial website ALLOWING NAR to publish its listings on it under the
operating agerment. The DOJ had good reason to tell NAR they could not
restrain Move, Inc. from accepting listings (paid listings only for now)

This is not entirely accurate Steve... the contract, as I understand it,
granted Move the right to manage the realtor.com website, and the right to
display MLS listings... Saul actually helped get the local MLS organizations
to sign on to this, travelling around to push it... but it is not ALLOWING
NAR to publish its listings, but rather allowing Move to publish them... at
least that is my understanding, and it is a big difference... IF it is as
you say, then NAR signed an even worse contract than I had thought... Which
way is it?

But either way, the difference is far from Semantic, and the contract far
from beneficial to most agents and brokers... it was a lousy deal from the
beginning, as far as I am concerned, and unfortunately, I don't believe it
has any renewal and review clauses that would give NAR the active ability to
manage what Move does with the site.

We have had this discussion before, and it went nowhere... now Move will do
as it pleases, and we will have NAR Leadership supporting it, for some
strange reason.

Also, please Note that there is a conflict of interest for Saul, who argues
in favor of syndication of listings for at least one reason: he is the CEO
of a company that syndicates listings and wants to compete with Move, and
other listing display companies... it is only reasonable that he supports
it... but he has his agenda there... fair, but should be pointed out that
Saul is not basing his decision to support this in a vacuum.

I am not sure I know what you think my position on this is Paul. So, to be clear, I do not think that for "sale by owners" should be able to capitalize on the critical mass of REALTOR listings on the Internet.As for the operating agreement and Realtor.com being the Official Website of NAR...In the beginning, there was no MOVE. NAR owned and operated REALTOR.com. It has morphed into what it is today, but is not the original value proposition.How it got to where it is today I have written about many times over the years. Yes, I was the first www evangelist in the real estate industry and worked hard to explain and socialize to brokers, MLSs and associations that they should accept the www as a marketing tool. The years were 1996 through 1998 and I still think the message was valuable and the the Web has benefitted brokers, agents and consumers. I am proud of the role I played in shifting a major information paradigm in the real estate industry at a time when hiding the data from the public was the norm.As for Realtor.com, NAR owns the web site, MOVE operates it. NAR has seats on the MOVE BOD. NAR still holds some stock if I am not mistaken, in MOVE or R.com.In fairness and full disclosure, I have no financial interest in MOVE or REALTOR.com. In some ways, Realtor.com may be considered a competitor to Point2 (I am the CEO of Point2), but as a REALTOR, I would not be in favor of a FSBO web site partnering with REALTOR.com, and I believe Errol Samuelson, the President of REALTOR.com and NAR when they tell me that there is no such arrangment.Saul

The bottom line is that they list with a web base broker who is partnered with the web site and they offer a X% which is below 1.5% to the Buyers Agent see InmanNews 11/14 Am edition. Have a happy day.

Apparently ForSalebyOwner.com was trying to pull a fast one. Here is what NAR and Realtor.com said in response to the ForSaleByOwner.com press release.

Lawrence, I did a little checking and found out some more information. This article is definitely misleading. What I think is probably one of the biggest issues is the confusion it will cause the consumer thinking they are getting a Realtor site because of the name Realtor.com. In the Nov.14 issue of Realtor.org/the magazine NAR makes a statement.REALTOR® Magazine-Daily News-NAR: ForSaleByOwner.com Statement Misleading

. I'm looking forward to Saul's comments. Thanks for sharing the news.

Whatever the outcome, I think it points out that as Realtors we must seek creative new business models, and educate consumers thur more and more communication of the value added by Realtors.

Also, Realtor.com must realize they are no longer the only kid on the block. Trulia, Zillow, and other listing sites are fast growing "kids".

I just logged onto realtor.org and there is a vehement denial on the part of realtor.com and NAR that any relationship exists between them and forsalebyowner.com.  There are assurances  that only listed properties can be on realtor.com. Forsalebyowner has been asked to retract their claims by both realtor.com and by general counsel for NAR.

Just to remind you...I think around 2004-2005, we had "MLS brokers", who for a small flat fee would put a listing into MLS...and then the seller was on his own.
 
Remember? I do. Because I had buyers who made an offer on one of those listings and we were instructed to negotiate everything directly with the seller. So, we invited the seller into our office and had them sit down at the same table with the buyers, whom I represented.
 
I basically let the buyers and sellers agree to price and closing date. Of course, I had coached my buyers before hand and they had comps. The sellers were just so delighted to get a contract!
 
Now, this was a pre-1978 built home and it needed a signed lead paint rider. I had the buyers, sellers and myself sign it. But, if you can believe it, the "listing agent" refused to sign the form, saying he didn't have to! So, I added a rider to the contract to that effect.
Found out later that he could have been fined by the Feds for violating their rulings.
 
So, our State changed their laws to require that all brokers/agents would operate with minimum standards...and those standards are now in all our listing/marketing contracts.
 
Very quickly those brokers faded from the scene and either left the business or went back to a more traditional model.
Minimum standards...are very minimum.

I'm phone so sorry about being brief. I am so tired of hearing the
negativatity. If we know these folks are on 6 months it appears that
we might drop in see the property build a bit of a relationship. No
more driving around looking for umrepresented sellers.
