"This is my listing. How come you are showing MY listings
on your Website?" with attitude, insinuating that our agent somehow had done
something wrong. Of course, we simply subscribe to IDX feeds for the MLS's
we are members of, and we display those listings allowed by us
 

My response would probably be: Obviously you have not heard of IDX. I think
you should ask your Broker to explain it to you. If they respond, they have
heard of it, then my next statement would be: Since you have heard of it,
you still should ask your Broker to explain it, as you evidently don't
understand it. And by the way, you do know buyers can contact whomever they
please to work with, don't you? If you would like to continue this
discussion, please call me later, and I would be more than happy to help you
understand this. When agent (if agent) calls, then you or your agent can
lambaste them for putting your buyers in a very uncomfortable situation, as
this is never acceptable in my opinion.

I have found that when markets are too good or too bad, agents here start to
blur the lines of what is proper ethical and professional behavior.

wonder why our industry gets such a bad rap...

I presume that this is the page the allegedly violates the rules: http://www.oshkoshneighborhoods.com/OurHomes.html

Your MLS rules may differ but here are sections from the model rules and to which your page appears not to conform.

Section 18.3.3
All listings displayed pursuant to IDX shall identify the listing firm in a readily visible color and typeface not smaller than the median used in the display of listing data.

Section 18.3.4
All listings displayed pursuant to IDX shall identify the listing agent.

Section 18.3.7
All listings displayed pursuant to IDX shall show the MLS as the source of the information.

In addition to Fred's points about potentially violating your MLS rules about how you present the IDX thumbnail and listing detail, my MLS also has rules that say that you can only display listings based on a search (like location, bedrooms, price, etc.). So, I can't just pick out listings out of the IDX database that I want to feature or exclude particular listings that I don't want to display.

While I believe your argument is that the Listing Agent should be happy with any and all exposure, IDX doesn't create a free-for-all. If you want to feature certain properties on your website, you'll need to get permission from the Listing Broker. It's the same as if you wanted to run a print advertisement featuring someone elses listings.

In our instance, the listings are by search, and comply with all MLS rules
regarding their display... there is nothing incorrect in our instance...
whatever assumptions may be made by Fred or you... we display listings as
allowed in MLS... the issue is with an ignorant or malicious listing agent
stealing buyers... Just because some agent says we should display listings
in a way that brings the potential clients to their website or has them call
the listing agent does not make it so... we have every right to display all
the listings that MLS allows us to display, in correct format.

That said, ignorance, while bliss, is also no excuse.
