 New Thread COE SOP 12-9

Most of us are aware that NAR added some SOPs to the COE in 2007 which deal with websites, urls, etc. Just my additional observation: many of those on RealTalk have electronic signatures which give no clue as to where the person is located, and what states the person is licensed in. IMHO, a signature you use should also contain enough information for the recipient to know where you are and whether or not you are licensed in the same state where they are.

yes, and many are regular posters on RealTalk.... understandable with newbies.... we don't need your whole life history (unless you want to, I'm always curious, but those long sig-tags may send an unintended message....), but at least give your city and/or state (Canada & elsewhere, whatever is appropriate).... Hi All,

Here in PA we have required information for our signatures.Internet Advertising Policy

A licensee using any Internet electronic communicationfor advertising or marketing, including but not limited to e-mail, e-mail discussion groups, websites and bulletin boards, must include on the first page of all communications the following data:

a. the licensee’s name;

b. the name of the firm with which the licensee is affiliated as that firm name is registered with the commission (abbreviations are not permitted);

c. the city, state/province, and *country in which the licensee’s office is located; and

d. the regulatory jurisdiction(s) in which the licensee holds a real estate broker or salesperson license (*including the licensee number).

*Although not required, strongly recommended

Melanie,

Thanks for starting a thread on the COE changes.

As chairman of the Hilton Head Area Association of Realtors Technology Committee and former chair of the Grievance committee, I was particularly interested to see the changes in the 2007 Code of Ethics that emphasized the requirement to be ethical in our on-line activities.

It was immediately apparent to our committee that many REALTORS would be immediately violating the code without even knowing it. As per your example, SoP 12-9 requires all Broker and Agent websites to disclose not only the name of the Firm but also the States(s) of licensure. How many us where doing that?

As you point out, it now seems common sense to make sure our e-signatures reflect the same.

Our obligation to refrain from making false or misleading statements regarding other REALTORS or knowingly re-transmit such statements by others is covered in SoP 15-2. How many of us are aware of the impact this has on our Real Estate Blogs? A careless comment posted by a member of the public on your Blog that is left unchecked, could land you in trouble.

As our committee discussions on this topic progressed it was even more apparent that many REALTORS did not understand the terminology in the code changes. Many did not know what a metatag was, yet alone know how to find if theirs' was compliant.

We resolved to help our membership by first making them fully aware of the changes and then breaking these changes down into language they would readily understand. In the coming weeks we will be producing a simple guide to the changes, making it easier to understand and comply.

I would love to hear from anyone who has either reviewed the code and implemented changes in their on-line activities as a result, as well as from those of you who may be confused as to what the terminology in the Code means.

Hi Tim Noctor, I interpret the rule you quoted as NOT meaning to cover simple emails, discussion groups, and chatboard/listserv communiques, UNLESS that email is used for MARKETING or advertising, like sending flyers over the internet, same rules/guidelines that apply for hard copy flyers.... COE SOP 12-9 seems to address websites ONLY. However, maybe it should be pointed out to NAR to include “signatures” on emails.
