How to Remove Foreclosures from Your Credit Report

A foreclosure can be reported on your credit report for 7 years and should be avoided at all costs. A foreclosure can be devastating to your credit scores. If you have a foreclosure on your record, credit repair should be one of the very first things you look into. A foreclosure can be deleted from your credit report just like any other negative account, but you must know what you are dealing with or you could actually make matters worse.

If you would like to remove a foreclosure from your credit report, you will first want to learn about your rights in the Fair Credit Reporting Act and all other laws having to do with foreclosures and credit reporting. The better you understand your rights, the easier it will be to have your foreclosure removed from your credit report.

Most people would claim that they don’t have the time or resources to commit to learning about the laws and their rights, but it’s very important to know your civil and consumer rights. If you don’t have the time you may want to seek legal help and/or consult with a credit repair company.

Credit repair professionals specialize in removing foreclosures and other negative items from your credit reports. They focus on correcting inaccurate and erroneous information on your credit report. If a negative item on your credit report is disputed and can not be verified by the creditor or contains any kind of inaccurate information it must be legally corrected and/or removed from your report immediately.

Chane - I have a legal and moral concern with your blog content.  First, credit repair is illegal.  You can't repair credit...you can correct items that are incorrect.  You can increase scores by balancing the negative items with establishing new accounts and paying them on time.  We do have rights under the Fair Reporting Act, but if in your statement,  "If a negative item on your credit report is disputed and can not be verified by the creditor or contains any kind of inaccurate information it must be legally be corrected and/or removed from your report immediately"  leads one to believe that all they have to do is dispute an item whether it's true or not and the creditor doesn't respond within 30 days, the item must be removed.  I realize the line above this states "they focus on correcting inaccurate and erroneous information on your credit report", but I have found in the many years in the biz that these "repair" companies have very few scruples.  I have no doubt you meant to post good and correct information to readers, but I wanted to throw in my two cents for clarification.

Credit repair is absolutely NOT illegal.  You can call any judge, prosecutor, attorney, law student...anyone and ask them if credit repair is illegal.  Most realtors know that it's legal and many of them refer clients to credit repair companies on a regular basis.

As a Real Estate and Mortgage banking professional with over 28 years of experience, it's embarrassing that you made this comment.

Please do some more research about the subject before you ever tell anyone else what you just told me.  You could really end up hurting people financially.  This subject is way too important for this kind of ignorance.

Shane - have some class.  Just because someone has a different opinion than yours or knows more on the subject is no reason for such remarks.  Scam artist are everywhere.  I hope you're not one.  Every legitimate Real Estate agent and Mortgage broker with any type of common sense knows you either correct incorrect information or you compensate the bad accounts with good ones.  I realize there are many that use the "system" to illegally remove derog accounts and get paid for it.  Here's a couple links.

Buy the way...is this what you do for a living or do you refer the clients to them and receive a fee.  You must be paid somehow for you have such a reaction from a simple post.

You questioned my integrity by commenting that I'm promoting something that's illegal and morally wrong.  And then later stating that you hope I'm not a scam.

Anyway, I'm not worried about my reputation.  I'm worried that people in positions such as yours are spreading misinformation.

I will apologize for my reaction if you promise not to tell people that credit repair is illegal and promise to do more research on the subject.   It could really help your clients and anyone else you might know that suffers from bad credit.

Remember, the credit bureaus are not your friends!  They are private companies that make money selling your private information.  They don't check with you to see if it's accurate.  They are not government agencies.

Under the Fair Credit Reporting Act, the only information that can remain on your credit report is not what is accurate, but what can be proven as accurate.  If it can't be proven/verified it absolutely must be removed.  This is not "my opinion".  This is FEDERAL LAW as clearly stated in the FCRA.

Chane - no need to apologize to me I was never offended by your comments just found them amusing...once again you've spun things a bit.  The Federal Law states the items the consumer is disupting are accounts that are HONESTLY incorrect.  If I have this law wrong, then please email me the document "highlighted" where is states you can lie and it's O.K.   I won't both to check my email for it because it doesn't exist.  BTW -I've never thought the credit bureaus were anyone's friend, no need to remind me.  Here is where we both agree.  In my opinion the whole credit system is dishonest.  They don't have to double check the information given to them.  This should be a requirement, but two wrongs do not make a right.  Lying to the credit bureaus "hoping" the creditor doesn't respond in the allotted time is wrong.  It's fraud and if the consumer gets caught, they can be prosecuted.  The difference between the two wrongs is that the credit bureaus reports whats sent to them by the vendor/creditor.  The credit bureaus are not required to verify (stinks), but they do not purposely report incorrect info.  The duty falls on the consumer to verify and disputed INCORRECT items. 

One other instance of dishonesty in my opinion is the fact that the bureaus can supply borrowers info to sleazy brokers through the "trigger" program.  More lunch money for the bureaus.

My point, which is obviously lost on you, is the importance of telling the truth.  I know this may baffle you, but I attribute my longevity in the business (28 years) to honest and moral behavor.  I have clients who have used my services for more years than you've been born (assumption from the picture).  With that said, I have loans to close. Say what you will...I finished with your blog.

Please point out where I've ever told anyone to lie to anyone.  You are the one twisting my words.  I've never told anyone to lie.  In fact, if you read my articles, I say that it's absolutely unnecessary and the consumer should NEVER lie to a creditor or the credit bureaus.

You're out of your league here talking about credit repair with me.  I've learned from the top experts in the country.  You should be a spokesperson for the credit bureaus.  They NEED consumers like you spreading misinformation.

You obviously have not read the FCRA because you're misquoting it.  The law states that once you dispute an account the credit bureaus must correct or delete inaccurate, incomplete or unverifiable information within 30 days

Whether or not the account is "really" yours has no bearing on the credit bureaus responsibility to verify it. If it can’t be verified, it must be removed from your report.  Creditors can NOT continue reporting accounts that they don't even have records for.  I tell my clients to dispute it saying something like this:

"Please provide documentation that the following accounts belong on my credit report and that my rights have not been abrogated. Otherwise please delete this damaging data immediately."

There is nothing dishonest, immoral or unethical about that.  I'm not telling them to say "it's not mine". 

If you really cared about your clients, you'd learn the truth about credit repair and help them get the best interest rates which will save them thousands of dollars.  Good luck to you, Dorene.

I think what we have here is  a debate on what the law is suppose to be,  Dorene believes that  law is suppose to be moral and therefore it is  inmoral to try to delete stuff from your credit report if it is factually true, however the law is based on technicalities and loopholes not what is morally right  ( your confusing the law and justice two things which are not mutually exclusive) so it is perfectly legal to challenge anything using the rules and laws to your best advantage, it dosen't mean it is the right thing to do  but it  is perfectly legal and people who do this  including myself are not criminals or engaging in fraud.

I am currently using a credit repair agency and they are doing a phenominal job on my credit report.  If you think that the credit bureaus are actually out to help us, you are mistaken.  Do you know how difficult it is to remove items directly with the bureaus?  It's nearly impossible.  Hiring an attorney or credit repair agency can greatly improve your credit score.  Yes, i'm sure there are many companies that scam people, but that happens everywhere.  It's up to the consumer to check their references and the B.B.B..  Personally, I had a foreclosure removed from my report.  I don't feel that it was illegal because the I used the bank's appraisal and it happend to be fraudulent.  Of course i didn't find out until after the fact.  Bank are practicing predatory lending tactics. So we have a right to fight back and remove foreclosures.

Your the man!  Keep up the good work..   After 4 foreclosures, I thought I was dead in the water.. Reading articles like this really helps out.   I hired a company to do the leg work for me..  Paying 35-40 a month to do my dirty work isn't going to break me..

Oh stop.  Talk about legal and illegal.  You know nothing.

The credit scoring system is the biggest scam ever perpetrated against law abiding american citizens. 

There are countless numbers of americans that have totally incorrect information on their credit reports but are helpless to get it removed.   I could type for hours about individual cases of people I've worked with.

I used to be one such person.  Even a notarized letter from the creditor directly was not good enough "proof" for the credit bureaus.  

Stop drinking the Kool Aid and spewing all this garbage about rights and laws.  The credit bureaus are PRIVATE DATA COMPILERS.  They make billions off of people with bad credit.   They don't care if your credit is good or bad and do only what they have to in order to remain in compliance.

It has absolutely nothing to do with whether an item is correct or incorrect on the credit report.  It is what the credit bureau can prove.

i just wanted to say that this site has been very helpful. I had givent up almost on trying to fix my problem. I have been in Iraq for 15 months, and the person in charge of my home did not do a good job witht he end result being my home when into foreclosure. i have been fighting for the last 8 months trying to get it back to no avail. So here i am a  26 year old that once had excellent credit to now trying to fix th corrections because i trusted someone else to handle my business while i was deployed. So this gives me home. and because i know that i did the right thing. I know that things will workout in my favor and that my credit will be great again  thanks for the information

chane, first of all you do not have 28 years of exp. This is a scam. Doren is right. Look up what the ftc has to say. Anyways, There are only three ways to remove debt from credit. Paying, bankruptcy or waiting 7 years.

I am an attorney and I CAN speak definitively on one thing you've said. Credit repair is NOT illegal. In fact, your statements that Chane is proposing or advocating an "illegal" process is borderling defamatory, so you should watch your words more carefully.  Don't loosley flaunt that allegation and then act put-off when someone takes offense. And yes, those were your words: "credit repair is illegal." So quit trying to backpaedlle and simply admit you were overgeneralizing.

I really hope that you are not telling your clients that credit repair is illegal. The burden of proof is on the creditor. If the creditor can not prove specifics as outlined in the FCRA, then yes, they must remove the information from the report. In fact, negative information is not supposed to appear on your credit report until the debtor has had the opportunity to dispute and validate the creditor's claims. So technically, if this process is not followed they have actually "broken the law" and can be sued in small claims court (FDCPA Section 809. Validation of debts [15 USC 1692g]. You may want to get with a more qualified source before placing misinformation in a blog.
