This page contains resource materials in connection with the recent judgment in the action brought by the Department of Justice against the National Association of REALTORS®.

The following multi-part video dialogue is brought to you by RealTown's Saul Klein and John Reilly and brings a unique insight to this settlement.


 

Video #1 is the first of eight videos that offers a brief history of the internet display of property listings to put the judgment into its proper context.



 

Video #2 focuses on the (Proposed) Final Judgment itself. We realize that  Associations, MLSs, and brokers will be examining in detail each part of this Judgment to see the impact on their business.The format we use is to read each line of the judgment and comment on the key areas - such as the fact that IDX is now clearly recognized by the DOJ as a valid business policy and that there is now a Modified VOW Policy to control what can and cannot be done with VOWs. Each of the definitions in the judgment is covered in detail. See Final Judgment Summary for an outline of key points.



 

Video #3 discusses the applicability of the final judgment including the prohibited conduct and the required conduct. Also covered are the means of enforcement of the policy as well as the designation by NAR of an Antirust Compliance Officer.



 

Video #4 completes the discussion of the Final Judgment as it pertains to permitted conduct. A key issue is whether the display is advertising or is it information. The DOJ is given extensive rights to insure compliance with the Modified VOW Policy.



Video #5 addresses the critical issue of who can participate in the MLS. Mere possession of a broker's license is not sufficient to qualify for MLS participation. The MLS Participant must "actively endeavor" to list real property of the type listed in the MLS and/or to accept offers of cooperation and compensation. See Exhibit B in Final Judgment Summary.



Video #6 This video introduces the Modified VOW Policy that is the centerpiece of the Final Judgment governing the use of MLS data in connection with Internet brokerage services offered by MLS Participants. The Policy has a direct impact on how MLS Participants can provide real estate brokerage services to clients and consumers through a Virtual Office Website. See Exhibit A in Final Judgment Summary.



Video #7 This video continues the discussion of the Modified VOW Policy and focuses on Part II. Policies Applicable to Participants' VOWs



Video #8 This video continues the discussion of the Modified VOW Policy and focuses on Part III. Policies Applicable to Multiple Listing Services. We conclude with a summary of the Final Judgment and comments about the overall impact of this decision.
