No Smoking Allowed - Illinois Law, Effective January 1, 2008

There has been much debate over the Illinois state-wide ban on smoking. Early concerns on part of the business community seem to be the question of the economic impact of the ban on such businesses as bars, resturants and other public gathering places. The issue is greater than that and many of us who have not thought through the legislation will find ourselves scrambleing to make immediate changes as of January 1.

The smoking ban applies to virtually all businesses and public places and can affect the way we all do business. At first glance, the broker/owner would need to post no smoking signs, insure that there was no smoking in the workplace, removie ashtrays within15 feet of the building entrance and insuring that no smoking takes place in this 15 foot area.

Points to Ponder

  • Would a business owner be responsible for an individual smoking in an automobile that was in a parking space within 15 feet of the business entry if the space were not designated a non-smoking parking space with appropriate signage?
  • How does the business owner tactfully request that a potential customer not smoke with 15 feet of the business entry and would it be necessary to have someone monitor the area to insure that the ban was complied with?
  • Who is responsible for cleaning up all of the ciggerette butts that are 15.01 feet from the business entry.
  • Would a real estate licensee need to refrain from smoking in his automobile and ask clients to do so if he offered to use it while showing property?

I am sure that there are many other questions that will be asked and that the broker owner or owner of any business needs to consider company policy and additions to a policy manual to specifically address the ban.

I just saw a waitress complain about the guy who would sit at her counter all day and drink coffee and smoke.  She was upset about losing that!  What about the many people that wanted to EAT at the counter but did not because of smoker coffee guy.  Please.  Smokers just don't get it!

it isnt fair to all the local bars. restaurant i can see, but not in bars. for those of who dont go to bars, people who drink smoke. plain and simple, why are they being penalized for smoking a cigarette, bought in illinois, having a drink an smoke. sounds like u want everybody to stay home. why do u let overweight people buy candy and soda? what is worse and more costly?

less people smoke now than did in the 60s and 70s but cancer  is on the rise so how can we blame cigs. i blame  cancer on more of these chemicals the specifically state dont let it contact your skin. so we put on our fields .wicch runs of our fields into water supplies that we asorb internally.the plant asorbs then we eat ,and absorb internally,were not to come into contact with these chemicals so lerts eat them.smart thinking,they complain about kids being more overweight causing,health problems,so whats next we going to close down mcdonalds because its causing just as much heath problems as cig.the state takes in over 1 million dollars a day on cig taxes if everyone quit the have to raise your taxes because they re not going to give up over 300 million dollars a year in tax income.and then if you beleive in god,when your time comes you are going to die how ever hes got it planned .wether it be cancer heart attack old age or plane flalling from the sky your gone.i just wonder which one of our rights is next

When fat people eat candy and drink soda I don't have to breath that candy or soda. Can't you smokers understand that.  If you want to kill  yourself feel free to do so, but Why do I have to get cancer because of your ignorance!

The way i look at this is the goverment feeling the need to tell us what we can and cannot do and turn around and do nothing on other matters such as sky rocketing electric bill that we in this state have delt with for a while until that got off there but and did something .  Take time to think about it laws get voted on by a hand full of people in spring field and for the most part they eather become a law or they dont depending on how much money is on table or is thrown at them determines weather they pass or not.  this law is just like all the laws in the past ,present & future will all be determined not by we the people but by the special intrest groups and how much money they got to offer . in closing there is something wrong when these same people that we elect into office can vote to give thereselves a  raise  we the people should be the ones to decide weather they get a raise or not  by voting on it ourselves . i wish i could go to work and vote on weather i get a raise but im not that lucky . i pay state taxes so in a way im one of there million employers like you are.my employer tells me what he wants done  and i do it in result i earn an income and my employer give raise and that is on how good i have done for them.

I really do not like the smoking ban in public places. But, if the government wants it to be that way so be it. But, the citizens of Illinois should have a say in it.

You know what? They need to come up with a SMOKERS PERMIT FOR BUSINESS,And let the businesses choose if they want there places to be smoking or smoke free! Im a smoker and i agree with the whole smoking around food thing,But heres a chance for the state to make money and the extra money they get...They can use to help the mass transit situation! SOMEONE PASS THIS TO THE STATE!

forget the permits. it is our right to have choices. just require a simple sign.  THIS BUSINESS IS NON-SMOKING or THIS BUSINESS IS SMOKING..... what ever happened to LIFE ,LIBERTY,AND THE PURSUIT OF HAPPINESS! it is our right .   if you dont like one or the other ,you dont have to go there .its your rights NOT THE GOVERNMENTS!!!!!!!

All i have to say is watch the movie 1984. big brother is watching you.  starting to look familiar to me. i mean if we are going to go this far then they need to outlaw cigs alltogether.and the whats next prohibition again.why not ? i am serious watch 1984. thats where we are headed.very scary.  this is coming from a non-smoker.   good luck and remember BIG BROTHER IS WATCHING!!!

Smoking kills, period. As a non-smoker, I choose to live. It's not fair that I didn't get to choose as I walked in to work every morning, have fun out with friends, or even sitting at a stop light. Smoke travels and second hand is far worse than first. Maybe if smokers smoked with something over their head to keep the cancer-causing fumes in, the ban would not have been necessary.

what about squad cars and city, state and village cars and trucks?? why are these exempt for smoking laws??? do taxpayers get to report smoking in these vehicles without repercustion????

Ok, I am a smoker, I agree with no smoking around children. I also believe it is the business owners choice for smoking or no smoking, its thier livelyhood not yours or the states. What are you going to do when the state DICTATES 2 fast food meals a week due to America being over weight? How about sex?? its deadly aids, herpes, v.d. etc.... should we only have test tube babies to save lives?? Think about what you are asking the government to do... Control your lives, so you don't have to make a choice. This is where we as a nation are heading. This goes so much deeper than smoking or no smoking. This goes against what America is. FREEDOM OF CHOICE! I know lets ban all smokers from any public place, because they smell of cigarette smoke and that might cause cancer, people get real this is not China or Russia.

Sounds like our government is trying to control all of us. Last I knew we still had our rights and freedom...perhaps we should ban drinking...gee...more people die from drunken idiots..why haven't they stopped that ?? sounds hipocritical to me...they say smoking kills, so does drinking...doesn't anyone believe in choice anymore?? if i dont' want to be around smoke..i will just walk away..it's that freaking simple...

if you have a problem with the smoker, don't attend a resturant such as denny's, or steak n' shake, because it's a diner, and people are prone to smoke at a diner. Being a "non-smoker" myself, i am fully against this non-smoking law because it's just another rule to follow. It takes away from our so called "freedoms." In America you can be free, but under the rule of a "dictator."

 first of all the choice should be all of ours. if you dont like it dont work there dont go there! when they take away the right to go to any bar you will hear more bitching. when they take away the right to skydive you will hear more bitching. think about the thing you love the most  (dont laugh) and when that right is taken away you will understand!!!!!!!!!!!!

i think that this is rule is stupid....i mean like all the nonsmokers dont wanna be around 2nd hand smoking but thats our decision to smoke and if they dont like it dont go to the places were there is smoking... nonsmokers like to remind us that were killing our selves but what about those who choose to drink instead of smoke that hurts there liver, or the people that do other drugs there hurting there bodies but they dont ever hear anything about it because its just themselves it isnt any one else.. i pay taxes so if i want to smoke outside in front of a building i will do so!! if the nonsmokers dont like it then dont come around me!!!!`

They act like this is a huge problem but when compared with something that actually has an effect when it hits you. Like obesity, to most Europeans we are nothing but a bunch of fat lazy Americans yet I don’t see the government telling overweight citizens that they are not allowed to buy candy or soda till they loose weight. I believe that issues like these the ones that actually cover our entire nation is what we should be focusing on state to state. Or how about the drunk driving I don’t see the any laws being passed showing that if you have a DUI you can’t go and get drunk at the bar any more which is how it should be. If you are going to limit our rights and break the constitution at least do it with a little bit more concern for the American people and not the government officials who benefited off of this new law passed. So instead of focusing our well trained police officers and other law enforcers after the criminals on the streets saving lives you have them writing smoking tickets and picking up cigarette buts.
