Topsail Island Short Sale Information – How To Prevent Deficiency Judgements – Topsail Island Real Estate Information

 

Short sales are very prevalent in the Topsail Island area as the market value has dipped below 2005 values. When you execute a short sale you are basically selling the property at current market value which is less than owed so the lender must agree to allow the sale to take place and hopefully claim a loss on the difference between market value and money owed. However, this is not always the case.

Some  bank mortgages are “recourse mortgages” which allow the bank to issue a judgement against you for any unpaid balances on the loan even though they approved the short sale and allow it to take place. On the other hand, non-recourse loans do not provide this option for the lender.

An example of the verbage you would like to see in a short sale transaction for example would be:

“as full and final satisfaction of the first mortgage indebtedness on the above-referenced property.”

However if you encounter verbage similar to below (all or a portion) the lender may seek a judgement against you for the unpaid balances:

“the lien will be released” but it “reserves the right to collect the remaining balance on your note after application of the net proceeds from the sale.”

It is important to understand these differences or you may have a surprise on your hands a little later. Consult your real estate attorney for more information.

The Topsail Island area offers two types of rental programs to offer cash flow on real estate residential investments.

 

Vacation or Weekly rental is typical on the island. An investor can expect most rental receipts in the time period between Memorial Day to Labor Day each year. Although, many rental properties do have weeks booked in the fall and the spring of each year here at Topsail Island.

 

The weekly price depends on several factors; proximity to the ocean, the home’s features and conditions & the neighborhood to name only a few. It is possible to figure approximately $300 to $700 per bedroom per week depending on the home and its location.

 

Many investors choose to rent an island home as a seasonal rental in the months between September to May. Typical monthly rents for this time period are in comparison with a peak week rental price. This is a great way to increase the gross rental receipts for the year.

 

The area also offers long term rentals, usually for a year lease, where someone lives in the property as their residence. The area has many military and civilian contractors due to its proximity to Camp Lejuene Marine Base in Jacksonville. The area is also fast becoming a bedroom community of Wilmington, NC, the largest coastal city in North Carolina.

After a week since the passing of Hurricane Irene and our properties being walked through, we are happy to report the damage to the Topsail Island area was minimal! North Topsail Beach, Surf City & Topsail Beach all did great!

Typical damage we reported were tree branches, several tree, shingles off and some siding. All very easy and inexpensive fixes compared to what could have been.

If you were to drive around Surf City, NC, many would be surprised by the recent commercial growth in spite of a slower national commercial trend.

The first three quarters of 2011  brought several exciting changes to the town and the area. Below are a few:

  1. Surf City, NC McDonald’s – Located on Hwy 50/210 across from the Gateway Shopping Center. All your favorite McDonald’s entrees plus double drive thrus for quicker service and a more upscale atmosphere with granite coutertops, stone facades, etc.
  2. CVS – Surf City, NC – Located beside the McDonald’s, the Surf City CVS offers prescription drugs, beach items, makeup and other items typical of the national chain of CVS.
  3. Harris Teeter – Located on Hwy 210 beside the Lowes home building store. All the typical items and atmosphere those who know of Harris Teeters are now offered in the Surf City location.
  4. Bojangles – Surf City is the home of the 500th Bojangles restaurant, located across from Lowe’s on the Hwy 17 South. It’s Bo Time!
  5. Auto Zone – Beside the Bojangles, Auto Zone Auto Parts for all your automotive needs.
  6. The Harris Teeter shopping center also offers nails, Great Clips, a pizza restaurant with other businesses coming soon.
  7. A Grand Asian Buffet has open in the former Seahorse Sports Bar spot in the Gateway Plaza on Hwy 210/50.

There is talk of other projects to come in the near future including a bowling alley, movie theater, apartment community and strip shopping center.

Dredging of Topsail Inlet Update – Topsail Island Real Estate News

 

A much need dredging project is in the works at Topsail inlet located at the south end of Topsail Island. Currently boaters are experiencing shoaling across the inlet and at low tide this becomes a dangerous situation for boaters heading out to the Atlantic Ocean.

 

The dredging project is also important because the US Coast Guard will likely remove the bouys marking the channel as they are not accurate for the water depth at this time. If a boater who is unfamiliar with the inlet follows the “cans”, they will likely end up grounded in the inlet at this time.

 

The project is slated to cost $400,000 in two $200,000 stages. The first stage will open the inlet up temporarily to decrease the risk to boaters and the last stage will put a more permanent solution in place that should save money and property in the future. Recently North Carolina approved the use of hard vein structures (jetty type structures), it will be interesting to see if Topsail Inlet takes advantage of this solution in the near future.

 

Currently it looks as though the state of NC, Town of Topsail Beach, Town of Surf City and Pender County are planning to share in the costs of the maintenance first stage plan through budget allotments and grants.

Topsail Towers – Topsail Island Real Estate History

Topsail Island was not always a favorite beach vacation or second home spot.

Just after the end of WWII, the United States began to test rockets to be used in modern jet propolision, spacecraft and missles. The operation was named, “Operation Bumblebee”, because like missiles of the time, bumblebees should not be able to fly.

At this time, Topsail Island was a barren barrier island with no homes, stores or even roads.

In March of 1947, the military research team built many structures to house the experimental project and provide a test platform. In the current town of Topsail Beach, ”The Assembly Building” was where the rockets were assembled. Directly in front of the building is a three story concrete tower that served as observation for the rockets while being fired off the coast of Topsail Island.

Topsail Island Towers - Topsail Island Real Estate HistoryThe military also built a road way system down the island to provide access to several other towers and buildings. In many places, the current road is in the exact place as first laid out in 1947.

During the next 18 months, an estimated 200 experimental rockets, each measuring six inches in diameter and between three and 13 feet in length, were fabricated at the Assembly Building, dispatched to the launch site, and fired along a northeasterly angular deflection of 15 degrees to the shoreline for a maximum clear distance of 40 miles.

The site was later abadoned by the military because of weather patterns and increased sea traffic. Although the foundation of the modern world of rocket and jet propulision was laid out right here in Topsail Island.

Today, many of the structures still exist but are modified as gov’t or community buildings (Assembly Building), homes and warehouses.

You can see original structures in the Town of Topsail Beach (a watch tower), half way between Surf City and Topsail Beach (another watch tower). In Surf City, there is a tower that has been modified as an oceanfront home while in Topsail Beach, a soundside home is built along the original watch tower. The site of the former Ocean City Pier in North Topsail Beach still holds a tower that was once used as the pier house.

Surf City Shipwreck – William H. Sumner – Topsail Island

It was a late Sunday afternoon in September, 7 1919. The Willian H. Sumner, a phosphate trade ship from Puerto Rico, was sailing northward heading to its homeport in New York City. At this time, it was usual to see three masted schooners sailing the carolina coast off Topsail Island . . .what was not normal is for them to be shouting distance from that coast.

The story goes that the young 25 year old captain on his first voyage in command had sailed too close to the shore while the currents and winds had died preventing him from sailing back offshore again. That is how the story went when told by first mate Charles Lacey anyways.

When the currents and winds left the schooner stranded near present day New Topsail Inlet, the ship drew closer to the dangerous shoals . .shoals that would rip the bottom out of a 165 foot schooner as she “grounded” on them.

This much is verified, the Sumner rail “aground” that September evening on the shoals in New Topsail Inlet (present day south end of Topsail Island). As the ship was pulverized on the shoals, the first mate made his way to present day Hampstead, where he promptly telegraphed the owners of the ships fate. It also seems that upon his arrival, the young captain was found in a pool of blood, a victim to gunshots, apparently self inflicted over the despair of losing the vessel on his maiden voyage.

By Tuesday, the ship had broken apart on the shoals, the captains body recovered and the jury appointed by the pender county coroner was unwilling to accept the Captain’s suicide.

It seems that the wounds on the Captain were quite curious, the right lobe of his ear was shot off and a bullet had hit him in between the temples . . .with no gunpowder marks on his face indicating point blank range from the pistol shot or suicide. Adding to the speculation, the ships log only noted “ship beached, anchor dropped” and the letters the captain had recently wrote were of cheerful tone.

The speculation is that the crew had asked the Captain to detour to pick up supplies and the Captain wishing to head northward to port would not. The crew then allegedly mutinied the captain and to their fear, ran aground at Topsail Inlet.  Now the crew was sure to be discovered as a mutiny crew and actions had to be taken. We can see the actions that may have been taken clearly now, stage a suicide and move on.

After several trials, the jury still could not decide and the first mate was set free to head to “Alabama on the first thing that smokes”.

Today, depending on the tide and winds, just south of the Surf Condos in Surf City, one can find the remains of the broken schooner with the murder mystery history. One of the broken up parts of the ship has found Surf City, 15 miles to the north, as its resting place buried in the sand to show itself once or twice each year.

TOPSAIL BEACH – The beach town has taken a turn away from seeking sand at offshore borrow sites and set its sights on inland sand sources for its interim beach nourishment project.
Mayor Pro Tem Julian Bone and Commissioner Grier Fleischhauer said the offshore sites and proposal by Coastal Planning & Engineering are not completely off the table but it appears as if another sand source could be preferable.
The town has hired Gahagan & Bryant Associates to investigate the spoil islands and shoaled areas behind Topsail Island for the amount of compatible sand needed to do the interim project.
“In his report, Chris (Gibson, from GBA) said that there appears to be enough material in both sites,” said Bone.
Two spoil islands – one at the south end of the town near Topsail Creek and the other just north of Harvey’s Cut – have been identified by GBA as potential sand sources.
The town had previously contracted to get sand from offshore sites; however, Bone said by using the spoil islands the town would get more sand at a cheaper price.

“We need sand on the beach and we need it to be affordable,” said Bone.
The cost difference comes mostly from the mobilization of equipment. The logistics of offshore dredging is more costly than that of dredging inshore.
At a meeting in March, Gibson told the board the cost would be about $10,382,850 if it used the spoil islands compared to $13,007,750 using sand from the offshore borrow sites.
In addition to saving money, the town also wants to keep the interim project on schedule and have construction begin in the winter of 2010-11. Bone said Gibson has stated that the work could be done within that time period.
The town had previously formed a citizens’ roundtable committee to gauge interest in the interim beach nourishment project.
The results of the roundtable were that the citizens wanted the interim project, wanted it done in a cost effective manner, wanted to stay on schedule and wanted to obtain oceanfront easements as soon as possible.
Bone and Fleischhauer said that more information came from the citizens of the roundtable – the need for a maintenance program for the project.
The solution, according to Bone and Fleischhauer, is to dredge the shoaled areas of Topsail Creek and Banks Chanel on a regular basis after the interim beach nourishment project is complete and pump the sand onto the beach as maintenance for the project.
Shoaling in that area can be problematic for water navigation. The US Army Corps of Engineers currently dredges the channels to keep them navigable.
Bone and Fleischhauer also contend that by increasing the width of the inlet from 80-feet to 150-feet and the depth from 8-feet to 14-feet, enough sand can be retrieved to maintain the beach project.
Much of the sand in the backwaters migrated there from the beach, said Bone.
“We are not a sand starved beach, we have plenty of sand, we just need to relocate it,” he said.
Bone and Fleischhauer said there are also other benefits to using sand from the backwaters.
Fleischhauer said that by using the alternative plan instead of getting sand from offshore, it would better benefit the oceanfront property owners, the boating community and the sound side residents.
Bone agreed.
“This situation would help more than the oceanfront homeowners in Topsail Beach,” he said.
One of the main goals, according to Bone, is to keep costs down and eliminate assessing the oceanfront property owners to help pay for the project.
Bone said the town has also been keeping cutting costs in other areas and that Interim Town Manager Rickey Smith has been instrumental in the cost cutting while still increasing employee benefits.
Another concern, according to Fleischhauer, is ensuring that nothing is done to jeopardize the regular beach nourishment project, which is slated to be done in the future and financed partially with federal funding.
He said he traveled to Washington, DC with the Topsail Island Shoreline Protection Committee and talked to area representatives and lobbyists.
He said the federal beach nourishment project is the ultimate goal and that he feels positive about it.
“I have high hopes we will get the federal funding,” said Fleischhauer.
He said the town has one more year of engineering and studies. If the funding comes through, he said the project should be “shovel ready” by the end of fiscal year 2011.
According to Fleischhauer, talking to the representatives and using the lobbyists is vital to getting funding for the federal project.
At this time, Fleischhauer said the next step is to formulate a financial plan for alternative project and then have the town board of commissioners vote on it.
Before any beach project can be done, easements need to be obtained from the oceanfront property owners. At a special meeting earlier this month, the board of commissioners worked on creating an easement letter to be sent to property owners.
The town attorney took the suggestions and will present the document to the board at its town meeting tonight, April 14, at 7 p.m. at the town hall.

N. TOPSAIL BEACH – An early morning fire completely destroyed one beach house and consumed about 75-percent of another.
The fire started at about 1 a.m. on March 27 at an oceanfront home that was under construction on Ocean View Drive in the neighborhood of Ocean Sound Village.
By daybreak there was little more left of the home than some charred timbers.
The second house was a vacation rental that was up for sale. Just a shell of the home remains.
It apparently caught on fire due to the flames and heat from the first one.
“It was a hot fire,” said Assistant Fire Marshal George Moore. “The houses were only about 15 feet apart and the heat and wind caused the fire to spread.”
Moore said that it was breezy that morning, with winds of about 7-10 mph.
The fire burned so hot, that another house 50-60 feet to the south suffered some effects from the fire.
No one was injured as both homes were vacant at the time of the fire.
Moore said mutual aid was provided by area fire departments, including Turkey Creek Volunteer Fire Department, Town of Surf City Fire Department, Sneads Ferry Volunteer Fire Department, Surf City Volunteer Fire Department, Holly Ridge Volunteer Fire Department, Sloop Point Volunteer Fire Department and Verona Volunteer Fire Department.
Mayor Dan Tuman stated that he wished to express his gratitude to the fire departments that responded to the fire.
The cause of the fire is unknown.
“It is still under investigation,” said Moore. 
Both homes were worth over a million dollars. The vacation rental that was up for sale was listed as being 3,844 square-feet, having seven bedrooms, six and-a-half bathrooms and for sale for $1,300,000.

What’s Left(y)?
One Loggerhead, sans one front flipper who’s relocated to new tank every few months to keep up with his ever expanding carapace. That’s “Lefty” almost two years later.
Long story short, he literally blew in and stranded on a beach during a ferocious late summer storm. He was post-hatchling size, but still just over a few ounces. If he were a letter we could have slapped a first class stamp on him and shipped him back to the Sargasso Sea where he belonged at that stage of his life.
If we tried to release him from the beach he would have been fish food before he made it past the first sandbar. He stole our hearts and we decided to give him a chance.
Like most newly arrived hatchlings, “home” was a large blue basin. Every day we experienced the agony of defeat as we watched him reject every kind of food we waved in front of his face. Until the day one of our volunteers stumbled on a delicacy he just couldn’t refuse – coquina clams fresh out of the sand.
Of course he demanded them every day for weeks and that kept our clam digger really, really busy.  As he grew we all recognized that we had created the sea turtle equivalent of a “foodie.”  He would eat everything we dropped in, and then look at us like we were starving him.

As Lefty got bigger we gradually upgraded his tank size, encouraging more activity, exercise and watching to see if he could swim in more than one direction with only one flipper. In the wild, turtles his age would spend most of their time hanging out on the sargassum rafts, foraging almost at the surface and doing virtually no diving. They’re pretty camouflaged and relatively safe in that environment.
So when Lefty wasn’t eating he was spending most of the day floating around on the surface and sleeping with his flipper tucked over his back.
That was then.
Now he’s a big boy, about 15 pounds.  And he’s figured out that the only way to get his food is to dive, so he’s spending more time eating, sleeping and basically just chillin’ at the bottom of his tank. We still don’t know how well he can really navigate with only one front flipper because we’re so crowded we haven’t been able to get him into a tank large enough for him to even try. He looks like he can do it, but when your tank is square tank and on the small side you really can’t go anywhere.
He’s doing the best he can with what he has. He takes each day as it comes and adapts to whatever it brings, always with a smile on his little Loggerhead beak.
In fact, Lefty reminds us of us. We perform amazing feats daily in a little square box. We take whatever resources we can beg, borrow and re-purpose and (in the words of Tim Gunn) “make it work.” And that’s not just not us blowing our own horn. Time and again we’ve been told by people that whenever they ask our colleagues about our turtle hospital the one common response is:  they do more, with less, than anybody.

HOLLY RIDGE — Holly Ridge Town Council is looking a gift house in the mouth.

The town decided not to accept the the donation of the Summerhouse Sales Center proposed by Southeast Waterfront Marketing, Inc.

Town council members unanimously rejected the offer at its regular meeting this week.

“The biggest reasons for not accepting the donation are the costs to the citizens of the town, not knowing what we were going to do with the building,” Town Manager Tony Fann said.

Southeast Waterfront Marketing offered to donate the building, a double modular unit with porches currently located at the corner of Sound Road and N.C. 17 but to be moved to property the town owns on Sound Road. Construction of the sales office, including the purchase of the trailer in 2007, cost more than $322,000, according to Southeast Waterfront Marketing’s proposal. The donation would have included the sales office, its custom porches and handicap ramp, landscape and related materials, landscape lighting, dishwasher, refrigerator and gravel if needed. The proposal stipulated that the town lease the building to Summerhouse for three years with two one-year options at a cost of $1 per year.

The town would be responsible for all the costs involved in the relocation of the center and had received a $27,300 bid from Carolina House Movers in Beulaville for the move. Additional town costs would include removal and replanting of the landscape, water and sewer taps, utility hook ups, maintenance and insurance.

The building must be moved from its current property by March 31.

Chris Scharf, the sales manager for Summerhouse, said it will now be up to Southeast Waterfront Marketing to find another use for the building.

The company plans to continue to have an office in Holly Ridge, either at another location in the town or on site at the Summerhouse at Everett Bay development.

Scharf said the decision has not been made whether to use the Summerhouse Sales Center at one of those sites.
